(“Lutheran Family Services” or “we”) and each user (“you”) governing the access to and use of any website owned and/or operated by Lutheran Family Services (collectively, “Site”). You understand that we cannot and do not guarantee or warrant that the Site or files available on the Site will be free from corrupted data, computer viruses or other destructive or contaminating code. To the fullest extent provided by law, in no event will Lutheran Family Services, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the site, any sites linked to it, any content on the site or such other sites, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

Notwithstanding the foregoing, the sole and entire maximum liability of Lutheran Family Services and its affiliates for any reason, and your sole and exclusive remedy for any cause or claim whatsoever, shall be limited to one hundred dollars (USD $100).
Any cause of action or claim you may have arising out of or relating to these terms of use or the site must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.

You agree to maintain the security of any account on the Site, including the security of your password (if any) and other confidential information relating to the use of the Site and your account on the Site.

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Nebraska without regard to choice of law rules. Each user agrees to submit to personal jurisdiction in the State of Nebraska and further agrees that any cause of action arising from or relating to the use of this Site or these Terms of Use shall be brought exclusively in a state or federal court located in Omaha, Nebraska.

No waiver by Lutheran Family Services of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Lutheran Family Services to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use shall be deemed unlawful, void or for any reason unenforceable by a court of competent jurisdiction, the validity and enforceability of any remaining provisions shall not be affected. When used in these Terms of Use, the term “including” shall be deemed to be followed by the words “without limitation.”

These Terms of Use constitute the entire and only agreement between Lutheran Family Services and each user of this Site with respect to the subject matter of these Terms of Use and supersedes any and all prior or contemporaneous agreements, representations, warranties and understandings, written or oral, with respect to the subject matter of these Terms of Use.

You agree to review these Terms of Use prior to your use of this Site and your use of this Site shall be deemed acceptance of and assent to these Terms of Use. Lutheran Family Services may, in its sole discretion, amend these Terms of Use from time to time. All changes are effective immediately when we post them.
